Los exportadores de la UE deben cumplir las decisiones sobre importación (tanto provisionales como definitivas) tomadas por terceros países, que se publican cada seis meses en las "Circulares PIC" (pueden consultarse en el Convenio de Rótterdam y en la base de datos ePIC.
En muchos casos, los países importadores no responden o lo hacen con una decisión provisional que no refiere a la importación. Para tratar este problema, el Reglamento (UE) nº 649/2012 exige que se obtenga el consentimiento expreso del país importador antes de que tenga lugar la exportación. Este requisito es aplicable a los productos químicos que figuran en las partes 2 y 3 del anexo I del Reglamento (productos químicos que reúnen las condiciones para someterse al procedimiento PIC y productos químicos sujetos al procedimiento PIC).
Por tanto, los exportadores deben, en primer lugar, verificar si el producto químico pertenece a una de dichas partes del anexo I. Si el producto está incluido en la parte 3, a continuación debe comprobar si el país importador ya ha tomado una decisión sobre la importación de ese producto, consultando la última Circular PIC publicada. Si el país consiente la importación sin condiciones, también hay que comprobar que el uso que se va a declarar coincide con el uso consentido en la Circular PIC. En caso afirmativo, no es necesario obtener el consentimiento expreso. El sistema ePIC facilita el proceso de comprobación.
Si el producto químico se incluye en la parte 2 o en la parte 3 del Anexo I pero no hay decisión sobre su importación, o sólo se consiente la importación bajo determinadas condiciones, ha de obtenerse el consentimiento expreso a través de la Subdirección General de Aire Limpio y Sostenibilidad Industrial. Para ello, la empresa exportadora deberá cumplimentar la solicitud de notificación de exportación siguiendo los pasos descritos en las " Instrucciones básicas para la notificación de exportación de productos químicos peligrosos prohibidos o severamente restringidos".
